My father passed in 2015 and for years they been holding into my father deposit refusing to return it until the 10 June 2020.The amount was originally agreed in Jan 2016 and since they refused to return those funds, arguing that I need to provide a letter from a solicitor that stated that I was the executor of my father estate, I didn't want to to that because would incur costs to myself of on average 256 pounds, No understanding why I need to do that because not even Banks requested such document from me and they had larger amounts. ( I provided ID, death certificate)there was a deduction to the total amount of the deposit which was agreed with the landlord on the amount in January 2016, which was different from the amount the landlord wanted to claim. However out the blue without my connect the landlord contacted the Benham and Reeves and requested the original amount he wanted to deduct given to him in November 2016 which Benham & Reeves honour with a strict understanding if there was a dispute this was going to be returned to me. This change was not verified with me and perjury was made to facilitate and Benham & Reeves. after January I was not pursuing this as it wasn't important in my life, I was in the final year at university and the loss of my father had already caused significant distractions and chaos to my life and mental state. However, I parked all the documents and emails to engage at future date.What I could not understand why my word was good enough to make decisions on deposit to my father deposit but to good enough for the deposit return to me. Earlier this year I send email to William with form and value agree and I was ignored. After waiting a few weeks and still no response, I began to ring the office's number and express my disappointment to several members of the company which confirmed someone would get in touch with me. On that same day, I receive the same response from William sorry we can't help without the letter from a solicitor(28/05/2020). To which challenged as previous why they are so special as a company that I need to provide them with such letter, I also notified him if he kept the same stance I would have no choice but take this matter via court it would. I was once again ignored.Well after a week also pass I rang the office again and complained once more and requested the matter to be escalated about William as I did before and Lady on the phone said she was going to pass that to the director and I would be hearing from them shortly.on that same day in the afternoon 12:25, I received an email from William stating that his superiors have agreed to refunds the balance as per attached so at that point I new document was generated with a different value. which I was confused by baring in mind William is the one that confirmed the landlord agree to my proposal of the deduction after I mentioned all the things it was breathed out of the contract, I was more than reasonable to agree to have some value to be dedicated which I was well within my right to contest to back in Jan 2016.I asked him to confirm is this was correct and he comes back with a response that I agree to this according to the landlord, Well I never agree to this! Why would I say yes take more money off me at a later date? When the mater on the value was already finalised? At the time, I also went through emails send sent him evidence that confirmed the value, and resent him the form at the time which I had signed of the original amount and challenging why this was changed? No explanation was provided just that they were following the landlord instructions.and by that point, I believe Benham & Reeves notice this review that I first published on 8th and Lady Lisa was taking over the matter and was going to get that resolved and asked me to be patient due to timeline it occurred and to amend my review as they were going above and beyond to get the matter sorted but it was not concluded at that stage.After a few backs and forth over a few days with Lisa, the original agreement was finally honoured, as I still had many questions why that occurred and no apologies of the mistake or logical explanations where provided and the matter was escalated to the Managing Director Vidhur on 10th June 2020, who finally offered an apology over the phone and admitted that mistakes occurred and offered a settlement which I agreed to after consulting with the family but its time to close the book on this As the matter been resolved and close, I have taken the decision to amended this from 1* to 2** and provided a more comprehensive description of the interactions. Although they might deserve 2.5 out 5, I can't score 0.5.

Hi Ms Gu, I can see you tried to rent a property through us in June 2018, not this year and you were informed at the time that a holding deposit is non-refundable if you fail tenant referencing or present fake ID or a fake passport. Following investigation, the issues were down to the complexity of wiring at your rental property and lack of available parts required. Please reply with solid data, what do you define by 'frequent'? We got our deposit deducted after months of waiting. Only when we contacted the agent in charge, she replied finally and instructed the release of deposit after deductions which was a violation of the contract as far as we were concerned. According to her, coincidentally the landlord instructed the agent to release the deposit on the very same day we raised a complaint after waiting for 6 weeks. Also they insist there was no breach of contract as they informed us that THERE MAY BE DEDUCTIONS 6 days after we moved out. A proper way of making communication to former tenants is to provide an ITEMISED LIST of things you'll deduct within 28 WORKING DAYS from moving out. That you failed and you also refuse to admit this.

Both the agent and the overseas landlord they represent can't care less about the well-being and SAFETY of their tenants as long as rent is paid. The consequence is, whenever we had any issues with the flat, particularly to do with (fire) safety, it took us the longest to get B&R to send someone and resolve (if AT ALL) the issue. For example, we had an entrance door stuck due to the mechanical fault, which prevented us from getting in/out our flat with tolerable ease, and it took them over two months to send someone who just went away after greasing the door. The problem quickly returned. On another occasion the entire building (where our landlord and his friend represented by B&R owns multiple properties, told by a B&R letting agent) had smoke detector alarm issue. It took them another couple of months to send each other emails around (cc'ing us in the mess) urging the other party to look into the issue.
Fed up with this, we resolved to move. After we moved/checked out, they said 'in accordance with clause 2.53 we require sight of your utility accounts, showing payment up to the termination of your tenancy with actual, not estimated readings'. Months after we moved in, we were chased by debt collectors for the bill unpaid by the previous tenant and their response?
'I’m sorry but we cannot intervene here as you are the account holder and you must contact supplier directly.'
Their procedure only works for deducting from the deposit of the previous tenants, not for protecting the current tenants.
Last but not least, it took them 6 weeks to release their schedule of deduction from our deposit. The contract clause they so love to throw at your face states
4.7. At the end of the tenancy, the Landlord’s Agent must tell the Tenant within 28 working days of the end of the tenancy if they propose to make any deductions from the deposit
According to this clause, it is clear to any reasonable person that they have breached this clause when they remained silent for nearly 6 weeks from the end of tenancy and therefore cannot make any deduction other than those already agreed during the period. However, the agent came back to my complaint that
We are well aware of the stipulated time frames in place and in accordance with such you were notified by my colleague xxx on (earlier date).
That said notification was
Please be advised that although we have not received the finalised quantification of costs from the landlord yet, there will be a deduction for the check out invoice, cleaning and there may also be other deductions.
Deduction for cleaning was nonsense because we used specifically the cleaning firm recommended by themselves and produced a receipt. I don't call 'there may also be other deductions' a proposal of making any deduction in any honest way. Again the agent couldn't care less.
I really would like to urge anybody who considers renting from B&R or the landlords they represent, to THINK AGAIN. Those shoddily constructed new-ish builds bought up by investors from overseas will only bring you no end of misery, not to mention that you'll have the additional headache from all the perilous wordings (reads 'loopholes') in their contract.

GoogleBenham and Reeves outsource all management for fixing items and maintenance. They do this casually, not informing the tenant of delays and the companies they choose to hire are absolute amateurs, taking three to four site visits of different staff to arrange repairs. Unfortunately despite all that time dedicated to working out the problem they still don't get it right and waste everyones time. Instead of trying to hire the cheapest and obviously least professional teams to save money Benham and Reeves should contract teams that have experience in the types of installs and able to complete a job the first time. They have terrible service, I had to chase them repeatedly for over a month to even hear what was going on. At writing they haven't managed to install a curtain, citing that they need another team to remove the rails that where there before. When I have emailed them they only gave me placating emails without any information on when the repairs would be completed, and they didn't seem to know. I seems that Benham and Reeves are completely out of control of the people they contract and have no power as a management office to get things done. I would suggest not working with them.
