TrustpilotBEWARE ! Don't sign their contract with the ' ready, willing & able ' clause in place
BEWARE ! This company's sales contract contains a ' ready, willing and able ' clause which allows them to charge the vendor the agreed sales commission if the property is withdrawn from the market and the sale is not completed. None of the sales team drew my attention to the existence of this clause at any time - of course !I have since researched this clause and whilst it may be legal to include it in a sales contract, if its existence is not made clear to a vendor by the estate agent before the contract is signed, this may put the agent in breach of The Property Ombudsman's Code of Practice. However, I note that the owner of Martin & Co claims that the company is ' proudly a member of the The Property Ombudsman Service '. The owner of the business has invoked the clause, the matter has become extremely contentious and I have made a formal complaint. An extract from his response is as follows:….................The terms under which commission becomes due are highlighted under the prominent heading ‘Commission Entitlement’. As you will be aware, whilst we as the marketing agent have a responsibility to ensure that all of our terms are prominently displayed and transparent, as a consumer you also have a responsibility to ensure that you are clear on the implications before agreeing to sign the agreement. In the case of any aspect of our contract being unclear, clients are encouraged to seek clarification. Obligations under The Consumer Contracts (Information, Cancellation, And Additional Charges) Regulation 2013, the contract outlines your right to cancel within 14-days. This term is included to ensure that consumers have sufficient time to review a document, can seek sufficient independent advice to fully inform them of the implications of the contract and can cancel without specifying a reason at any point within this period. ….............So, learn from my mistake. I definitely could not recommend this company to anyone who is considering selling their house. In my experience, this company can not be trusted to be open and honest with potential customers in contractural matters and when challenged, treat their customers with dismissive contempt.A perfect example of the old adage ' Caveat Emptor ' - ' Let the Buyer Beware '.

Letting service is really poor not only during one year tenancy they delayed boiler change - I had to live without heating nearly two month, then they tried to evict me before my tenancy was finished. When I left property it took them ages to return deposit I had to chase it up my self.Plus they deducted from deposit 50£ towards Redecoration when actually in the final report it is obvious that walls were scuffed and marked before my tenancy started!!!
