Dear Mr Wayez Ahmed. Thanks for sending in your review, though it’s an extremely unfair reflection of how we work. We operate an open-and-transparent estate agency and addressing criticism, is part-and-parcel of running a successful business. We have an overwhelming number of 5-star reviews which are a clear reflection of the way we work and how we do our best to help people. Nevertheless, I’ll address your negative review. I have, once again, looked into your tenancy notes. You were a joint tenant with a Mr Red (full name not written due to GDPR regs) and undertook tenancy in 2014. You left in 2016. Mr Red was the lead tenant and my Helping Tenancies team always communicated with him in person/ telephone calls/ emails. Your issue mentioned in your review dates in 2016 and yet you chose to write such comments today, in 2022. In 2016 we received complaint from Mr Red that upon ending your tenancy the Landlord did not return your security deposit. Upton taking the tenancy it was agreed that the Security Deposit will be given to the Landlord and they will register the funds as the law states with a Deposit Protection Scheme. It was made very clear that your money will be passed on to the Landlord whereby it then becomes their responsibility to fulfil their legal obligations. The Tenants signed this agreement from the onset, so gave full consent and understood ARQ Homes do not hold the deposit. We cannot stipulate to a Landlord with which Deposit Scheme to register a Deposit with, It’s not our responsibility as the legal onus then befalls upon the Landlord. In 2016, I personally oversaw communication of the file. I responded to Mr Red. I never had communications with you since you never wrote to us. I prayed at the local Mosque and used to see Mr Red a lot. He was comfortable speaking to me about his concern and equally saw my displeasure in the Landlord’s actions. I supported your claim against the Landlord who broke protocol and released all file notes. I provided a witness statement against your Landlord. We even offered to pay for a case consultant to assist your claim as a gesture of goodwill, since where a Landlord does not register a deposit, a claimant can pursue a return of 3 times the amount of the deposit. However, Mr Red chose to use his own. I wrote a three-page letter to your advocate in 2016 and released all file notes to help your claim. It was clear we had a complete paper trail of evidence against the Landlord and assisted Mr Red in his pursuit. He thanked us, though he was understandably disappointed that a Landlord could break the law, to their own detriment, like this. The reality is, in this industry, you will come across the occasional scrupulous Landlord/ Tenant who flout their legal responsibilities. It’s a very difficult job, to have, at times. The irony of it all, of course, is your review. Where years later, you have called us dodgy. Which is an absurd comment to make. There’s no negligence of duty on our part, neither did we take your money. Its something we would never do! We’re not sure why you have chosen to take your vengeance out on us. However, Mr Red, the lead tenant left us a 5 star review on Facebook. Clearly, he knew, that everything we do here at ARQ Homes. Is done with the best of intentions and that is to help people! To our readers: We cannot stop people making unfair complaints against us. It’s the nature of some people, that someone out there will always criticise no matter. how kind, courteous and helpful you are. However, in this case, we have been in business over 13 years now and we are accustomed to 5 stars every time from grateful users of our service. If we were dodgy as Mr Ahmed commented, then believe me, we would be having loads of testimonies against us, like this.
