Dear Beth, I’m sorry that you were unhappy about the deposit deductions that your landlord instructed us to agree, and were subsequently decided by independent adjudicator, the TDS. The Tenancy Agreement does require that carpets are professionally cleaned at the end of the tenancy, hence our landlord insisting on this. My colleague met your joint tenant at the property to collect the keys and carry out the move out inspection, reminding her of their obligation to get carpets professionally cleaned. Additionally some areas of repainting were needed where damp/ mould had accumulated and makeup was spilled on a wall. We supply all new tenants with a booklet at move in, on how to properly ventilate a property to ensure condensation issues are kept to a minimum. I know you advised that you didn’t feel the damp and condensation was your responsibility as you were not instructed how to use the trickle vents on the windows but our landlord did not allow this as defence. The Landlord had photos taken on several occasions showing you drying clothes on the radiators without windows open, and felt that contributed to allowing condensation to build up hence asking us to proceed to the Tenancy Dispute Service. The landlord was also unhappy that you had painted a wall with non matching paint. As you know, the TDS decided in the Landlord’s favour, awarding a proportion of the deposit requested to cover the carpet cleaning and decorating. Rex Gooding register every Tenant’s deposit with the TDS. We carry out an Inventory, 3 month inspection and Move Out report at the end of each Tenancy. It is then the Landlord’s decision on what deductions need to be made from the deposit (if any). If the Tenant does not agree the case is sent to the TDS as a third party adjudicator who will make a final decision within 28 days of what deductions are to be made from the deposit (if any) and reward the Tenant and Landlord accordingly. The decision on what deductions are made from the deposit does not lay with us as the Agent. Once again, I am sorry that you were not happy with the decision.
