We terminated Cubitt & West after a series of serious failures involving gas safety, communication, contractor quotations, accounting and misleading marketing. Gas safety is our greatest concern. Following a gas safety check arranged through Cubitt & West, Gas Safe Register subsequently identified safety defects and the gas supply was disconnected. We requested the contractor’s return on 8 September; the return appointment was set for more than two weeks after our request. The tenants remained without gas. We consider the handling and lack of a timely practical resolution unacceptable and potentially dangerous. We learned from the tenants that Cubitt & West took their deposit twice. The tenants were very poorly treated. Their move-in was delayed due to documented failures by Cubitt & West. There were communication failures and numerous inaccuracies in the inventory. We have raised a separate formal complaint requiring the payment records and an explanation. In my view, their responses also show a poor understanding of their legal obligations. Their marketing states: “Do you add Commission onto Repairs & Maintenance? NO”. Yet they rely on terms providing for significant contractor “referral” payments. Their explanation is that the contractor pays them rather than the agent adding a charge to the quotation. I contend this is seriously misleading, particularly because I specifically raised commissions and such payments before appointing them. Their property manager stated in writing that the company “is not responsible for scrutinising or validating the commercial basis of quotations supplied by third-party businesses”. That is an extraordinary position for a paid managing agent with a financial interest in contractor invoices. We were quoted £748.80 for cleaning a modest, empty, already-cleaned four-bedroom house. We independently obtained quotations from four different companies for professional cleaning, including carpets, each below £390. We repeatedly found ourselves doing the work of managing the property while paying them to do it. After termination, they stated that no handover processes would begin until their forms were signed and disputed termination fees paid. They also said they would continue managing the property and processing rent despite our express withdrawal of authority. We had to contact the tenants directly and refer conduct we consider unlawful to The Property Ombudsman. They subsequently recognised the termination date and agreed to commence handover, but their later demands appeared to reverse that position again. These contradictory responses have left us with no confidence that they know how to handle the process properly. Serious concerns about the handling of our funds, including failure to return unused balances, remain under investigation. The tenants’ report about their deposit raises further concerns about the handling of tenant funds. In my view, the documented handover, communication and client-money failures breach The Property Ombudsman’s Code. We have also raised consumer-law complaints about the marketing and termination demands. These matters have been referred to The Property Ombudsman. This experience has involved repeated chasing, contradictory positions and substantial work for us as owners. It has also seriously affected the tenants. We paid for professional management and lost confidence in the service.

Cubitt and West have been amazing. The striking difference between Cubitt and West and more traditionally run estate agents is the proactively and their belief. Particulary, Caitlin, Mia, Maddie and Paul. Who have really been the difference in our sale process. Ideas outside the box, pragmatic and honest opinion and the fact that nothing has been too much trouble. I believe that our house would still be on the market, as all the other similar houses where we live are, some for considerably longer than ours. The Cubitt & West branch we used were absolutely fantastic. Always there when we needed them and always the most helpful, especially when we had any questions or issues. My only personal issue with the company would be their use of a certain solicitors. I was deeply unhappy with their recommendation of solicitors who they recommended. You may say that I could have got my own but at that moment, being a first time buyer, I felt very much pushed into that choice. Things were great with the company themselves though. We were assigned Julie to help us and she's been absolutely spectacular. The amount of calls I've made to her to moan is frankly ridiculous but shes always been there to help, to explain what's going on and why, and to be that voice of reason when we needed it most.
