DISPUTE PROCEEDURE UNDER THE HOUSING ACT 2004 Landlords expect their chosen Letting Agent to ensure their Properties are returned in an acceptable condition when their Tenants vacate. The Complainant (who remains anonymous and therefore unknown to us) is wrong to suggest we as Letting Agents can make spurious claims to take Tenants deposits. This comment alone discredits the Complainant as the Deposit is held by The Deposit Protection Service (DPS) an independent government approved body. The Deposit is held in trust by the DPS on behalf of the Tenant to protect their interests, should an unscrupulous Letting Agent try to make a bogus claim. Where the Tenant believes a proposed deduction from their deposit is unfair, they have the right to have the matter brought before an Adjudicator (who is a trained Solicitor) under the Dispute Resolution Service. The Adjudicator collates evidence and allows each party to make representations before deciding on the validity of the claim. The burden of proof is on the Lettings Agent, as it is rightfully assumed that the Deposit is the Tenants. The Claimant has to prove beyond reasonable that their claim has any merit. There is no other route available to the Lettings Agent to access the Deposit except for the Tenants express permission. The Complainants comments are therefor ill-informed and factually incorrect. We are rightfully proud of our reputation and will not allow malicious postings to go by unchallenged. Kind regards, Dhaminder Sidhu Managing Director Solihull Residential Lettings
