NONSENSE...! Please allow me to correct you with the facts, but first, I must apologise for the delay in responding to you until today (3rd January) We all freely celebrate Christmas in our own way, so whilst it was important for you on Boxing Day! to fire out a succession of poor reviews to several companies including ours, I chose to relax and enjoy the festive break with my family and loved ones, and as such gave your comments no thought whatsoever until today, but hey, people are strange. Now that I am back I am very pleased to have the opportunity to correct you on the actual facts that led to the sellers withdrawing from selling to you. 1. We (Estate Agents) act for the seller, they employ us, they pay us, and we have a legal duty to act at all times in their best interest. Buyers can use our services for free and we will happily give good service to all we encounter, buyers included, but make no mistake we do not work or act for anyone other than the seller. 2. Definition of Gazumping: Make a higher offer for a house than (someone whose offer has already been accepted by the seller) and thus succeed in acquiring the property. I thought it important to highlight the above two points in advance of me outlining the chronological facts of your aborted purchase. You agreed to purchase the property in question in early September 2021! At the point of your offer you outlined your position as CASH from the sale of your home. This strong financial position was influential in the vendors decision to accept your offer. However, in late January 2022 you backtracked on this and notified us that you were not going to use the cash from your sale, and in fact you were now going to take a mortgage. It then took you until early March to provide details of your appointed financial adviser, despite us asking repeatedly. The clock was now running at 6 months since you'd offered and we'd instructed the sale. However, as probate had initially been awaited (granted on 7th March 2022) the vendors patiently waited for you. By mid June with still no sight of your mortgage offer the vendors patience began to wear thin, as such as part of our efforts to act in our client (the sellers) best interests we suggested they consider remarketing the property, they declined. In early July we finally heard from your lenders surveyor who were instructed to complete the valuation survey. As such we now expected your mortgage offer and therefore exchange of contracts imminently and without further delay. In mid September the sellers patience (understandably) finally broke and they elected to set a deadline for exchange and officially put you on notice that should you not exchange contracts within a 10 day period they would reoffer the property for sale. On the 28th September (nearly a week past the 10 day deadline) you hadn't exchanged contracts nor did you have suitable mortgage monies available to do so. You had now been trying to buy this property for over a year, with probate granted for over 6 months. So yes, the vendor reoffered the property for sale, just as they told you they would and we found a more proceedable buyer for a better price shortly thereafter. So to summarise. You were aware probate was awaited, however, this had no bearing on the delays or the reasoning for the sale not proceeding to you. On the contrary to your suggestion we negotiated brilliantly for our client (the seller) securing them thousands and thousands more. The sellers showed incredible buyer loyalty to you, giving you the exclusive opportunity to purchase the property for over a year. You were not gazumped as you were not the buyer at the point the most recent sale was agreed. The reason your dreams were shattered lies squarely at your door not ours!
