first reply is on Mr Rojan's review. this is the continuation of our comprehensive reply. 'Again, the terms of the property reservation along with the referencing documents; and the move-in balance was all clearly stated in the formal offer acceptance email sent to you on Tuesday 29th August 2023. Upon satisfactory full tenancy referencing, which was expedited to fulfil your urgent needs, the move-in date was set for Friday 1st September 2023. You requested the earliest possible date (which was three days after approval! Thus, making our team push to ensure the administration for your move was prepared). On the move-in date, we administrated and prepared the documents for the landlady to sign in your presence, at our office. The landlady made special arrangements to attend at short notice from Cambridge, further facilitating your needs. There were no changes made to the terms/clauses in the contract, contrary to your statement! At this meeting, you raised an enquiry that an additional person will be joining you at the property during the term of the tenancy (which was not disclosed at the onset or at any point to us or the landlady) to which the landlady expressed her concern/view and the legal implications, considering the property is situated in a Landlord-licensing borough. Although we assured her regarding legal and procedural requirement to which she eventually agreed. Despite resolving this, to our bemusement, you decided not to proceed with the move-in. At this stage we once again informed you that you are at risk of forfeiting your property reservation amount of £570 if you choose not to proceed after all obligations and procedures having been met. You all chose to leave the office and informed us that you wish to discuss and decide among yourselves. Approximately 20 mins after not hearing back from you we contacted you as the Landlady was still in the office. You confirmed with a counter- condition and advised that you were not comfortable with the Landlady’s response and would only consider renting the property if we were intermediaries and acted as managing agents in between. After speaking to the Landlady, we managed to convince her to opt for our management service. In a further telephone conversation with you, we affirmed the landlady’s consent/agreement for us to manage the property on her behalf to accommodate your preference. Despite going that extra mile to help you secure this property you refused to accept to move into the property. At this stage you were advised again that you will be in breach and will result in the forfeiting of £570. According to Tenant Fee Act 2019, ‘a holding deposit can be retained by the landlord or the letting agent’ if the ‘tenant withdraws from a property’ or ‘fails to take all reasonable steps to enter into a tenancy agreement when a landlord or agent has done so’. On Saturday 2nd September 2023 you were sent an email to formally put in writing what happened and that you have unfortunately forfeited your £570. Another email on 6th September 2023 was sent in response to your reply highlighting the reason for the forfeit but you decided to walk into our office without an appointment to demand the return of £570. Our office manager (Ali) discussed this with you, but you continuously raised your voice over his. We have an office decorum here; hence the Company Director came out of his office, clearly others were being interrupted/disturbed from their work and suggested we have a private office to discuss matters between manager and customer (all which can be concurred via our cctv camera footage). During this unannounced appointment, you were returned all the referencing documents you provided along with the final referencing reports received for each of the applicant. You were also explained by the office manager (Ali) himself that during his 10 years of service at ARQ Homes, (the reply continue's on Mr G Sagoo's review. He is the Landlady's son and testifies to our honesty.
